5 Overlooked Steps In Getting Separated

Nobody expects to go through a separation, but they can be all-too-common. They’ll be a difficult time to get through emotionally, but there’ll be far more to worry about than that. You’ll have to take a few notable steps when legally separating from your partner.

If you’ve tied the knot with them, it can be an especially complicated time. What if you could get through these easier? While you’ll still need to deal with your emotions, you shouldn’t have to struggle with the rest of the process.

Five of the more notable steps can be easily overlooked, especially when you’re dealing with how you’re feeling. It’s worth being sure you don’t forget about them.

1. Get The Documents You Need

You’ll need quite a few documents in-hand when you’re getting separated, as they’ll help you fill out the paperwork you need. At the same time, they work as evidence you and your partner are actually married and are who you say you are. Make sure you have all of these from the start to make things easier for yourself.

Outside of anything related to the marriage itself, you’ll need to have documents showing your address, your now-ex partner’s address, and more. Try to get these together before filling anything out so you can make the process as straightforward as possible.

2. File Your Application

Now you have all the documents you need, you’ll have to fill in and file your application. You can do this with your now-ex partner, or you could decide that one of you does it. Either way, it’s a part of the process that needs to get done early. It’ll be your first proper step in getting separated from your partner.

You’ll have plenty of areas to fill in with this, such as whether you need the court to make specific decisions about your separation, such as splitting assets. Be thorough when you’re filling this out so you’ve everything sorted.

3. Make A Financial Agreement

At a certain point, you’ll need to come up with a divorce financial settlement. This is where you and your partner decide on how your joint assets will be split. It’s usually one of the more complicated parts of the process, and there’ll be a decent bit of negotiation involved in it.

It’s normally worth getting attorneys involved if you can’t decide on this amicably and you don’t want to have a constant back and forth. While this can be one of the more stressful parts of getting separated, it’s usually a necessary part of it.

4. Get A Conditional Order

You’ll have filed your separation application already, but that doesn’t mean you don’t need to file anything else. After a little bit of time, you’ll have to get a conditional order in place. Usually, this takes place about 20 weeks after you’ve applied for your separation in the courts.

With the order, the courts will decide whether your application can go ahead as is, or if any changes need to be made. It also gives you and your partner time to decide whether you still want to go ahead with the separation.

5. Ask For A Final Order

Now that you have your conditional order in place, you’ll have a little bit of waiting to do. While this varies depending on where you live, it’ll be at least a couple weeks. Though you mightn’t want to wait this long, it’s a mandatory part of getting separated, so it’s something you’ll have to do.

After that, you can then ask for a final order. Usually, this will be the same as your conditional order, but it’ll be a permanent one. See it as the finalisation of the separation and the last thing you’ll need to do. You can do this the same way you went about the conditional order, and it shouldn’t take you much time to get after you apply.

Getting separated is never an easy experience. On top of the emotions you’re feeling, you’ll have to deal with more than a few steps, both legal and otherwise. Because of how you’re feeling, many of these can be easy to overlook, despite how important they might be.

They’ll be something you need to get through at some point, though. If you want to get through the process quickly, it’s worth getting them out of the way as soon as you can. It’ll mean you don’t have to worry about it anymore in the future.
