When you get married there is no doubt that the last thing on your mind will be divorce. Unfortunately as you go through life we change and evolve and that can mean you start to drift apart. Perhaps you form different interests and as a married couple you start to have less in common with each other. This will consequently cause a lot friction and this lead to arguments. Gradually the marriage starts to break down. It is always sad when a marriage breaks down but it happens. Staying in a marriage because you have children is pointless. If you have children it’s far better to have two parents who are happy living apart than two unhappy parents living in the same home.

Of course if you have children together and the decision has been made to get divorced, it’s very important that the wellbeing of children is paramount and that both parents are able to sustain and continue their relationships with their children separately. Before applying for a child arrangement order, it’s very important that you try to reach an agreement. If this isn’t possible you can go to a mediation information and assessment meeting. This is where a mediator will try and help you resolve your differences amicably. If this doesn’t work out then you will have to go to court to obtain a child arrangement order.

What is a child arrangement order?

A child arrangement order is a court order that sets out the arrangements for the child or children and when they will spend time with each parent. Of course this can cover a number different things so that each parent is totally happy.

A child arrangement order will set out many arrangements such as who the child will live with primarily, when the child will spend time with each parent such as after school, weekends and school holidays. It will also, if needed, set out any conditions that are required during visits such as if a supervisor is required. Of course it’s also important to remember that children will quite often have grandparents and a child arrangement order can also make sure that grandparents get to spend time with the grandchildren.

The court when deciding on a child arrangement order will take into account the wishes and feelings of the child and also the ability of each parent to meet the needs of the child to name a few.
